Terms of Service

1. Acceptance of Terms

By purchasing a Simchalo eSIM plan, you agree to these Terms of Service. If you do not agree, do not complete a purchase. These Terms constitute a binding agreement between you and GEAR Ventures LLC, a South Carolina limited liability company, doing business as Simchalo ("Simchalo," "we," "us," or "our").

2. Eligibility

You must be at least 18 years of age to purchase from Simchalo. By completing a purchase, you represent that you are 18 or older. Your device must be unlocked and eSIM-compatible to use our service. Simchalo is not responsible for purchases made on carrier-locked or incompatible devices.

3. Service Description

Simchalo sells prepaid US data eSIM plans for use on the T-Mobile & Verizon national network. Plans are data-only; no voice calling or SMS service is included. An eSIM activation code (QR code) is delivered to your email address or WhatsApp number shortly after purchase, usually within a few minutes. You install the profile on your device before or after arrival in the United States.

eSIM profiles are delivered via remote provisioning in accordance with GSMA standards. Successful installation requires an unlocked, eSIM-compatible device and WiFi access at the time of profile download.

4. WhatsApp Business Channel

Simchalo offers an optional purchase and support channel via WhatsApp Business (+1 301-200-1886). By messaging this number you agree to interact with an automated service operated by Simchalo through the WhatsApp Business Platform (Meta Platforms, Inc.).

Use of the WhatsApp channel is also subject to WhatsApp's Terms of Service.

5. Orders and Payment

All prices are in US dollars unless Stripe Adaptive Pricing displays your local currency. Your order is final when Stripe confirms payment. We do not store your credit card number or full payment credentials; all payment processing is handled by Stripe, Inc. under their PCI DSS Level 1 compliance program.

By purchasing, you acknowledge that you are purchasing a digital good delivered electronically and that your right to cancel under certain consumer protection statutes may be limited or waived once the product is delivered.

6. Refunds

Please review our Refund Policy, which is incorporated into these Terms by reference. No refunds are issued after activation. A limited refund window and specific exception categories are described in the Refund Policy.

7. Acceptable Use

The Simchalo data plan is provided for lawful personal use only. Prohibited uses include but are not limited to: unlawful surveillance, distribution of illegal content, data tethering for commercial resale, automated network abuse, and any use that violates applicable US federal or state law. Simchalo and its carrier partners reserve the right to terminate a data plan without refund for confirmed policy violations.

Temporary travel use only — no permanent roaming: Simchalo plans are intended for international travelers visiting the United States on a temporary basis. Use of a Simchalo eSIM for more than 60 consecutive days within the United States constitutes "permanent roaming" and is prohibited under our carrier network agreement. Plans found to be in violation of this policy may be suspended or terminated without refund.

Geographic purchase restriction — UAE: Simchalo eSIM plans may not be purchased, activated, or used from within the United Arab Emirates. UAE telecommunications regulations require a local operating license that Simchalo does not currently hold. Purchases originating from UAE IP addresses or UAE payment methods may be declined.

8. Network and Carrier Dependency

Simchalo's US data plans operate on a US national carrier network. Network availability, coverage, speed, and uptime are subject to that carrier's own policies and infrastructure. Simchalo makes no guarantee of coverage in specific locations, minimum data throughput, or uninterrupted service. Data speed may be reduced ("throttled") after your plan's data allowance is exhausted; this is standard carrier practice and is not grounds for a refund. Carrier outages or network maintenance are outside Simchalo's control.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SIMCHALO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMCHALO'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SPECIFIC PLAN GIVING RISE TO THE CLAIM, OR (B) USD $25. IN NO EVENT SHALL SIMCHALO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages; in such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Intellectual Property

All content on the Simchalo website, including text, graphics, logos, and product descriptions, is the property of GEAR Ventures LLC or its licensors and may not be reproduced, distributed, or used without written permission.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction for violations of intellectual property rights.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Notwithstanding the foregoing, mandatory consumer protection laws of your state of residence may apply regardless of choice-of-law provisions.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
